Welcome to MilandDil Design’s website.  The www.milanddildesigns.com website (hereinafter referred to as the “Site”) is comprised of various web pages operated by MilandDil Designs (“hereinafter referred to as MilandDil”). The site is offered to you conditioned on your acceptance with modification of the terms, conditions, and notices contained herein (hereinafter referred to as the “Terms”). Your use of the site constitutes your agreement to all such Terms. Please read these terms carefully and keep a copy of them for your reference if you so desire.

The site is an E-commerce site where MilandDil Designs offers a full line of custom silk floral arrangements, centerpieces, wreaths, seasonal décor, home décor and gift items.

Electronic Communications

Visiting the site or sending emails to MilandDil constitutes electronic communications. You consent to receive electronic communications and agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email and on the Site, satisfy any legal requirement that such communications be in writing.

Your Account

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that MilandDil is not responsible for third-party access to your account that results from theft or misappropriation of your account. MilandDil and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content in our sole discretion.

MilandDil does not knowingly collect, either online or offline, personal information from persons under the age of thirteen (13). If you are under eighteen (18), you may use thewww.milanddildesigns.com only with permission of a parent or guardian.

Cancellation and Refund Policy

Your item must be in its original unused condition to be returned, unless there is a makemanship defect. You must return the item with thirty (30) days of your purchase.

2. Ship your returned item along with a signed letter in the package stating the reason for the return along with a copy of your original sales receipt to:

Return Exceptions

Merchandise that has been worn, used, or altered will not be accepted for return, exchange or refund.

Restocking Fee

All damaged items are subject to a 25% restocking fee which will be deducted from your refund. Original order shipping and handling fees charged will not be refunded.

Exchanges

If your item is in like new condition, you may exchange it for a different product. In that case, the restocking fee will be waived, but you will still be required to pay return shipping on the item.

Pricing Disclaimer

MilandDil reserves the right to refuse or cancel orders if an item pricing or shipping calculations are shown incorrectly as a result of human or technological errors, or by third-party tampering or hacking. In the rare event such a pricing discrepancy does appear on your order(s), you will be contacted by Customer Service to review the correct price before you are charged and the merchandise is shipped.

Shipping

Orders placed after 2:00 pm CST Monday - Thursday will be shipped with 24 hours of order placement. Orders placed after 2:00 pm on Friday, or on the weekend Saturday or Sunday, will be processed for shipment on the next business day which is Monday. We will diligently try to ship orders same day as the order is placed if at all possible.

Shipping rates are estimated only and may require additional payment by the buyer to cover actual shipping costs. We reserve the right to hold the order until such time additional shipping fees are paid after invoiced. We also reserve the right to change your method of shipment if we find a comparable service for a better price.

Shipping overages paid at checkout are refunded to the customer at our discretion.

Sales Tax

Applicable sales tax will be added to your final order for items shipping to the State of Louisiana.

Termination/access restrictions

MilandDil reserves the right, in its sole discretion, to terminate your access to the Site and the related services or any portion thereof at any time, without notice. To the maximum extent permitted by law, this agreement is governed by the laws of the State of Louisiana and you hereby consent to the exclusive jurisdiction and venue of courts in Louisiana in all disputes arising out of or relating to the use of the Site. You agree that no joint venture, partnership, employment, or agency relationship exists between you and MilandDil as a result of this agreement or use of the Site. MilandDil’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of MilandDil’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the Site or information provided to or gathered by MilandDil with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.

Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and MilandDil with respect to the Site and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and MilandDil with respect to the Site. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form. It is the express wish to the parties that this agreement and all related documents be written in English.
